I had the same issue when my diesel Peugeot was totaled. I did get
sales history from Rentschler's Peugeot near Reading, PA but they
insurance adjuster ignored it as not being a close enough market.
(yet less than 1 hour away). Support your claim with price estimates
from Old Car Price Guide and Cars of Particular Interest which are
based on sale history. The insurance company sometimes has no sales
history and phones a used auto dealer for the price. You need to know
how they arrived at their price including all of their data points.
Dont allow them to use NADA or a similar database because your car is
to o old and unique. You must use a guide related to special interest
automobiles. It helps to have your demand written by an attorney.
Also you can hire a private appraisal. And you must look at your
entire case, any shared liability, bodily or punitive claims that can
be made. I had a case where a unique bmw was totaled, the insurance
company claimed my client was partially at fault. I got the police
report which found the incident a result of road rage. I further
found a criminal record for the other driver. So I threatened
punitive damages along with personal injury. The insurance company
quickly changed their tune. The moral is to get all of your case
information, before you make a demand. I found here in Pennsylvania,
arbitration tends to compromise.
